Terms of Use

These terms explain the rules for using GrowHive, buying through the marketplace and selling produce as an independent GrowHive grower or producer.

By accessing GrowHive, creating an account, buying through the marketplace, listing produce or using GrowHive community features, you agree to these Terms of Use where they apply to you.

Sellers are responsible for their listings, produce, legal permissions, fulfilment and the information they provide.

GrowHive

GrowHive provides the marketplace and tools that help buyers and independent sellers connect.

1. About GrowHive

GrowHive is an online marketplace designed to connect customers with independent growers, farms, farm shops, allotment growers, home growers, food producers and other local sellers.

GrowHive provides the marketplace technology, account tools and related services that allow sellers to list produce and customers to discover and purchase it.

Unless GrowHive expressly states otherwise for a particular product or service, the seller offering an item is responsible for supplying that item to the customer.

2. Accounts & eligibility

You must provide accurate information when creating or maintaining a GrowHive account.

  • You are responsible for keeping your account details and login information secure.
  • You must not create an account using false, misleading or impersonated information.
  • You must keep important account information reasonably up to date.
  • GrowHive may restrict or suspend accounts where there are reasonable concerns about misuse, safety, fraud or breaches of these terms.

3. Buying on GrowHive

Product listings are created by individual GrowHive sellers. Customers should review the product description, price, quantity, delivery information and seller details before placing an order.

Availability of fresh produce can change quickly. An item may occasionally become unavailable due to harvest conditions, stock changes, damage or other circumstances outside the seller's reasonable control.

Where an order cannot be fulfilled, the seller or GrowHive may need to cancel or adjust the affected part of the order and arrange any applicable refund.

4. Orders from multiple growers

GrowHive allows customers to purchase from more than one grower during the same checkout.

Each grower fulfils their own part of the order. Shipping, local delivery or collection arrangements can therefore be different for each seller.

Separate delivery or shipping charges may apply to each grower. These charges should be displayed before the customer completes checkout.

A customer may complete one GrowHive checkout and payment even though the order contains products from several growers. Different parts of the order may be dispatched, delivered or collected separately.

5. Prices, payments & marketplace fees

Sellers are responsible for setting the prices of their products unless a particular GrowHive feature states otherwise.

Prices, delivery charges and any applicable marketplace or service charges should be shown to the customer before the order is completed.

GrowHive may charge a Service & Support Fee or other clearly disclosed marketplace fee. Any fee charged to a customer will be shown during checkout before payment is confirmed.

GrowHive may also apply separate fees, commissions or payment arrangements to sellers in accordance with the seller terms or marketplace settings applicable to their account.

6. Grower & seller responsibilities

GrowHive sellers operate independently and are responsible for the products they list and supply.

By selling through GrowHive, a seller agrees that they are responsible for checking and complying with the rules that apply to their own circumstances.

  • Having permission to sell produce from the land, premises or growing location they use.
  • Obtaining any registrations, permissions, approvals, licences or certifications required for their activities.
  • Ensuring products are safe, suitable for sale and accurately described.
  • Providing accurate pricing, quantities, availability and fulfilment information.
  • Following applicable food safety, hygiene, labelling and consumer requirements.
  • Fulfilling accepted orders using the delivery, shipping or collection options offered to the customer.
GrowHive does not routinely verify every legal obligation that may apply to every seller. Sellers remain responsible for understanding and complying with the requirements that apply to them.

7. Allotment & community growers

Rules affecting the sale of produce grown on an allotment can vary depending on tenancy agreements, allotment rules, site rules, council requirements and other arrangements.

Allotment growers must satisfy themselves that they have permission to sell produce grown from the land or site they use before offering that produce through GrowHive.

8. Food safety & growing practices

Sellers are responsible for supplying produce that is suitable for sale or sharing and for following relevant food safety requirements.

Growers using plant protection products, pesticides or other regulated growing products are responsible for using authorised products correctly and following applicable label instructions, harvest intervals and other requirements.

GrowHive may remove a listing or restrict an account where there is a credible concern relating to food safety, legality or customer welfare.

9. Organic produce & regulated claims

Sellers must not describe products as Organic or use other regulated claims unless they are entitled to make those claims and hold any certification or approval required for them.

Where GrowHive provides an Organic verification or certification-status feature, sellers must provide accurate information and must not attempt to misuse, reproduce or circumvent verification badges.

GrowHive may remove Organic wording, remove a badge, request further information or restrict relevant listings where certification cannot be supported.

10. Product descriptions & country of origin

Sellers must provide accurate and non-misleading information about their products.

Any country-of-origin information should describe the actual origin of the produce where such information is provided or required. A seller's location must not be used as the product's country of origin where that would be inaccurate.

Photographs should reasonably represent the item offered. Natural differences in shape, size and appearance are expected with fresh produce and do not necessarily mean a product is defective.

11. Shipping, delivery & collection

Sellers control the shipping, delivery and collection methods they make available through GrowHive.

Sellers are responsible for providing reasonable and accurate information about their fulfilment methods and charges.

Delivery estimates may be affected by harvest availability, weather, courier delays and other circumstances.

Customers should check fulfilment information before completing an order.

12. Cancellations, refunds & customer rights

Nothing in these Terms of Use is intended to remove or reduce any statutory rights that a customer has under applicable consumer law.

Cancellation and return rights can vary depending on the type of product purchased. Certain rights may apply differently to goods that are perishable, personalised or otherwise subject to a legal exception.

Where produce is damaged, spoiled, unsafe, materially different from its description or otherwise affected by a problem, customers should contact the seller as soon as reasonably possible.

GrowHive may assist buyers and sellers in resolving disputes, but this does not remove any legal rights or responsibilities that apply to either party.

13. Free food & community sharing

GrowHive may allow users to offer produce for free or participate in community food-sharing features.

Free does not mean that safety responsibilities can be ignored. Users sharing food should ensure that it is suitable to give to another person and should provide relevant information where appropriate.

GrowHive may remove community or free-food listings where there are reasonable safety, legality or misuse concerns.

14. Community features & communications

GrowHive may provide discussion boards, comments, community projects, events, messaging and other communication features.

Users must communicate respectfully and must not use GrowHive to harass, threaten, deceive, spam or abuse another person.

Users must not post unlawful, dangerous, fraudulent or deliberately misleading content.

GrowHive may remove content or restrict access to community features where necessary to protect the platform or its users.

15. Prohibited listings & activity

Products or activity that are unlawful, unsafe, fraudulent or otherwise inappropriate for the GrowHive marketplace must not be listed or carried out through the platform.

  • Stolen, counterfeit or unlawfully obtained goods.
  • Unsafe food or produce knowingly unsuitable for sale or sharing.
  • False certification or misleading Organic claims.
  • Products that a seller is not legally entitled to supply.
  • Fraudulent listings, false identities or attempts to manipulate GrowHive systems.
  • Content or activity that infringes the rights of another person.

16. Reviews, images & user content

Where users submit reviews, photographs, comments, listings or other content, they remain responsible for the content they submit.

Users must have the right to upload or publish that content and must not knowingly provide false, defamatory, unlawful or infringing material.

By submitting content intended for public display through GrowHive, you allow GrowHive to display and use that content as reasonably necessary to operate and promote the relevant marketplace features.

17. Account restriction & suspension

GrowHive may temporarily restrict, suspend or close accounts where reasonably necessary, including where there are concerns about:

  • Fraud or attempted fraud.
  • Serious or repeated breaches of these terms.
  • Unsafe or unlawful products.
  • Misleading certification or seller information.
  • Significant customer safety concerns.
  • Abuse of GrowHive users, staff or systems.

Where appropriate, GrowHive may ask a seller for information or evidence before deciding whether an account or listing can remain active.

18. GrowHive availability

We aim to keep GrowHive available and functioning, but uninterrupted access cannot be guaranteed.

Features may occasionally be unavailable because of maintenance, technical faults, third-party services, security issues or circumstances outside GrowHive's reasonable control.

GrowHive may change, improve, remove or introduce features as the marketplace develops.

19. GrowHive's responsibility

GrowHive operates the marketplace and supporting platform services. Independent sellers are responsible for the products they list and supply.

Nothing in these terms excludes or limits liability where it would be unlawful to do so.

GrowHive does not guarantee that every seller, listing, harvest, delivery estimate or item will always be available, error-free or suitable for every individual purpose.

Users remain responsible for making appropriate decisions based on the information available to them and for complying with obligations that apply to their own activities.

20. Privacy & personal information

GrowHive processes personal information in accordance with its Privacy Policy and applicable data protection requirements.

21. Changes to these terms

GrowHive may update these Terms of Use when the marketplace, its features or applicable requirements change.

The date at the top of this page shows when this version was last updated.

Where a change is significant and affects existing users, GrowHive may provide additional notice where reasonably appropriate.

22. Applicable law

These terms are intended for the operation of GrowHive as a UK marketplace.

Any mandatory legal rights or protections that apply to a user based on applicable law remain unaffected.

23. Grower Declaration

Growers may be required to accept a separate Grower Declaration before accessing certain seller features.

The declaration is intended to confirm that the grower understands key responsibilities relating to selling, permissions, food safety, regulated claims and the produce they list.

Acceptance of a declaration does not transfer the seller's legal responsibilities to GrowHive.
